From August 4th to 6th, the China PV Summit and China PV Investment and Financing Forum 2016 was held in Hangzhou. Event sponsors include Chinese Renewable Energy Industries Association (CREIA), China Photovoltaic Industry Association (CPIA), Solar PV Committee of China Renewable Energy Society, Industrial Work Committee of Chinese Renewable Energy Society and Global Solar Council (GSC).

As a representative of law practitioners in new energy, Jane Chen, the director and founding partner of Sunshine Law Firm, was invited to attend and speak at the event. In the opening year of the 13th Five-Year-Plan, China PV Summit 2016 continued to adhere to the tenet of “gathering the wisdom of leadership, collecting the force of industries, seeking the matter of development”. The Summit invited over 200 attendants, both domestic and international, including renowned experts and scholars, industrial leaders, and investment firm representatives to meet at the West Lake to discuss about photovoltaic power industry’s development, opportunities and future. Meanwhile, the China PV Investment and Financing Forum 2016 comprehensively demonstrated heated topics of investment and financing of photovoltaic power projects such as quality control, data monitoring and standardization of distributed generation projects. 

Invited by Mr. Junfeng Li the Director of the National Center for Climate Change Strategy and International Cooperation (NCSC), New Energy Department of National Energy Administration (NEA), Renewable Energy Center of National Development and Reform Commission (NDRC) and Zhejiang Province Economic and Information Commission made excellent speeches, which straightly hit issues of how photovoltaic power as the leading force in the global energy transformation could grasp the new development opportunity and adapt to market competition. Director Jane Chen summarized and analyzed eight relevant legal issues in legislation, legal enforcement, and risk control, which covered developer equity transfer, land use tax, three-way photovoltaic (industrial, agricultural and fishery photovoltaic) project, deferred payment of photovoltaic subsidy, grid connection and power curtailment, EPC contractor’s qualification and construction quality standards, and risk avoidance and cost of financing. Jane’s speech received a wide recognition of participating experts and investment representatives.

In preparation for this Forum, Sunshine Law Firm participated in the drafting of distributed photovoltaic model contract. The Forum introduced the national photovoltaic public data platform and the distributed photovoltaic model contract, in the hope of helping photovoltaic power projects with financing and valuation through enhancement of transparency and information of project assets. At “China PV Investment and Financing Forum 2016”, Zhijian Ge from Sunshine Law Firm put forward, combining the on-going reform of China’s distribution and retail sales of power, that the distributed energy would become the “UBER” in energy sector, and that the current power sector reform provides distributed energy with good timing and opportunity. 

At August 4th closed-door session, industrial leaders explored the drive of industrial growth, and came to the Photovoltaic Leader Declaration and the Suggestions for Photovoltaic Industry Development, which were regarded as the industrial consensus and practical suggestions for promoting global photovoltaic development and Chinese energy transformation. This put forward the wish that photovoltaic industry leaders can promote the global photovoltaic development, and make suggestions for promoting Chinese energy transformation to the annual “International Forum on Energy Innovation” held by Chinese government under the context of the G20 China Summit held at Hangzhou in this September. 

According to reports, this is the fifth “China PV Summit”. In the past four years, “China PV Summit” deeply analyzed, discussed and exchanged on industrial hot topics of global market, policy trend, technology transformation, subsidy of grid connection, quality standard and industrial financing, and received strong support and high recognition from governmental authorities, industry representatives of upstream and downstream enterprises, domestic and international experts and scholars, and industrial associations.
